The situation escalated when Gigaba’s parliamentary office released a statement claiming the National Prosecuting Authority had instructed him to present himself in court. The statement indicated he would face formal corruption charges related to alleged tender irregularities at Transnet during his tenure as minister.
However, the Investigating Directorate Against Corruption quickly provided clarification on the matter. IDAC officials confirmed that while Gigaba had engaged with investigators, no arrest had been made and no court appearance was scheduled for the immediate future.
The conflicting narratives emerged just one day after EFF leader Julius Malema confronted IDAC head Andrea Johnson about the slow progress in state capture cases. Malema specifically mentioned other prominent ANC figures, including Chairperson Gwede Mantashe and former minister Nomvula Mokonyane.
“Our inability to defeat corruption is that high-profile individuals with money don’t get prosecuted,” Malema stated during the exchange. Johnson responded by assuring that more arrests of state capture implicated individuals would follow in due course.
Political analyst Andre Duvenhage believes this could signal the beginning of more high-profile arrests. He expressed confidence that prominent figures would face legal consequences if constitutional institutions remain functional.
“The Zondo commission has shown us that all the important political elites in South Africa, particularly ANC elites, are directly or indirectly involved in state capture,” Duvenhage noted. He emphasized that the ANC as an organization benefited from numerous questionable deals.
Duvenhage also criticized President Cyril Ramaphosa’s approach to implementing the Zondo commission recommendations. He suggested the president lacks the political will to fully confront corruption within his party’s ranks.
“Ramaphosa does not have the political will to implement these recommendations,” the analyst stated. “He has said in the past that he is not prepared to take decisions that will divide the ANC.”
The analyst further questioned the effectiveness of the ANC’s much-publicized step-aside rule, describing the party’s ethics committee as inconsistent in its decision-making processes.
